Trapido: "make it a criminal offence to be a witch" ?

In 'Make witchcraft a criminal offence' [1] and 'Calls to make witchcraft a criminal offence as 81-year-old woman stabbed 50 times' [2], Michael Trapido writes
"So until such time as someone can put forward a better suggestion for protecting people accused of witchcraft — and not the current law which makes it an offence to call someone a witch — legislation to make it a criminal offence to be a witch seems to be the only answer. In tandem that anyone now possessed of this legal channel to accuse witches, who practices self-help, be given the stiffest possible sentences available to a court faced with that charge. Denying some form of religious freedom is very ugly but what happened to an 81-year-old woman and many others like her is far uglier."
Any attempt to suppress witches, historically the object of religious oppression, in order to end witch-hunts is not only illogical, it is devoid of all ethical legal sensibility. Suppressing Witches and Witchcraft in South Africa will not prevent further accusations of bewitchment against innocent citizens. On the contrary, it will encourage even more spurious accusations.
Trapido suggests that someone might be able to proffer a more suitable suggestion to ending witchcraft accusations? Perhaps he could be persuaded to review the findings of the 'National Conference on Witchcraft Violence'. [3] Political parties, safety and security institutions, civic organisations, churches and labour movements committed themselves to bringing an end to witchcraft-related violence with the adoption of the Thohoyandou Declaration on Ending Witchcraft Violence in 1998. [4]
In response to the findings of the Conference the Commission on Gender Equality launched an ‘Action Plan for the Eradication of Witchcraft Violence’ by committing itself to monitoring the progress of “legislative reform, victim support, the reintegration of victims into communities, and reconciliation and public education programmes” aimed at eradicating ‘witchcraft violence’. The CGE’s Action Plan included
a) strengthening the South African Police Service’s ability to respond appropriately to incidences of violence related to Witch-hunts and accusations of Witchcraft, b) making the eradication of violence against suspected Witches a national budget priority, c) special training for police in handling Witchcraft violence, d) the creation of special investigative units, e) the creation of victim support units to facilitate reintegration and conciliation, f) the adoption of a comprehensive public education and awareness campaign, and g) comprehensive legislative reform of the existing Witchcraft Suppression Act.
The right to cultural prejudice against Witchcraft is not enshrined in the constitution of South Africa. The right to life, liberty, equality, dignity and belief belongs to all South African citizens equally by virtue of birth. No South African citizen may commit murder, and no South African citizen may discriminate against Witches based on their own personal religious or cultural bias or prejudice.
The South African Pagan Rights Alliance offers its sincerest condolences to the family of the murdered victim of witchcraft-violence, and calls on all South Africans to support 30 days of advocacy against Witch-hunts in Africa from 29 March to 27 April 2010. Trapido - thoughtless and offensive
Thu, 01/14/2010 - 12:38 — ErebosSo to stop “witchcraft-related” murders, Trapido would support a new law that bans non-violent religions that practice Witchcraft, such as Wicca.
Also, the South African Pagan Council is a recognised Religious Organisation with Home Affairs and the Revenue Services, and to enact Trapido’s ban on witchcraft, the government would have to knowingly outlaw a religion they have deemed as deserving legal recognition.
Furthermore: In an April 22 2008 article, “Is religion the new social evil? Pope on the slippery slope?”, Trapido refers to himself as an “Orthodox Jew respectful to all faiths, including those who do not believe in any organised religion or in any religion at all”.
"...respectful to all faiths.." Really?
In the same article he says: “If we consider the prejudice, intolerance and disgusting behaviour of some members of the various religions, it is hardly surprising that people are turning their backs on organised religion.
He also wrote: “People are quickly informed about the conduct of those who are teaching love, tolerance and redemption, while their behaviour suggests otherwise.”
I would say that as far as him claiming to be against “... religious prejudice, intolerance and disgusting behaviour”, his latest writing (and dare I say thus his behaviour) does indeed suggests that he falls in that very same “otherwise” category.
These murders (and all others) are terrible but the solution is education and the enforcement of existing laws, not arbitrary and discriminatory new laws.
Perhaps Trapido should take note of the following quote:

I reiterate my admiration for Damon's constant battle against biased and insensitive journalists. This latest display of ignorance is yet another case in point.
I believe our answers to such ones are numerous and well recorded. I can't help thinking that we are rather like a dog without teeth. We growl, bark but have little to show for it. I do however, fervently believe that through SAPRA and the good Pagans in our country we will make a difference. Ultimately! When someone so much as raises an eyebrow at other religions (such as the Muslims and Jews) we see very quick retractions and apologies, when tackled by such organizations. The reason for this is quite simple. Journalists and the likes of Trepido know full well that such organizations have the finances to sue the pants off them.
We do not!
Pagans in this country need to think well about this. Surely if everybody donated a meagre amount such as R20 a month with current membership this would result in R72 000/year. A lawsuit of the nature we need would cost about R50 000. We could have this money within the year if everyone played their part. The SAPC would then be in the position to fund SAPRA's legal action when needed. Should the suit be successful, it would set a precedent and go a very far way towards assisting our Cause.

I should add that SAPRA has no intention of recklessly entering into a legal battle for the sake of it. Any decision to do so will be reviewed by two experienced attorneys before any action is taken - we need to be certain that we will win, and for the right reason. We will consult with the SAPC executive members and affiliate members before undertaking any costly legal battle.
